Our step-by-step guide

Step 1

County Court Judgment

Have a County Court Judgment (CCJ)? If not, we can support you.

Day 1

Step 2

Transfer-up

Once you have received your CCJ, our legal team can transfer it up to the High Court.

CCJ passed to Marston Recovery, and the transfer up process starts.

Step 3

Writ of Possesson

The High Court will then issue you a Writ of Possession, which our legal team will transfer to us at Marston Recovery.

Day 14 - 16

A Writ of Possession is issued within approximately 14-16 days.

Step 4

Formal Notice

Our High Court Enforcement Officers can now start the enforcement process of recovering your property or land

+2 Days

A formal notice is issued to the tenant to leave the property within two days.

Step 5

Re-possession

Our High Court Enforcement Officers can now start the enforcement process of recovering your property or land.

+ 14 Days

After a statutory 14 day period, the property or land can be re-possessed.

County Court Judgment

To pay by post, send a postal order, cheque or banker’s draft, made payable to ‘Marston’ to the address above. Make sure that you write your name and our reference number on anything you send us and if sending us a payment, on the back of the postal order, cheque or banker’s draft so we know what the payment is for.

Transfer Up instruction form

This service allows you to apply for County Court Judgments to be transferred to the High Court for enforcement.

Writ of delivery instruction form

Our Enforcement Officers are well equipped and experienced in recovering all types of fixed assets whether it be a single car or fleet.

We can enforce judgments obtained in the High Court and almost any judgment issued in the County Court.
