The Challenge:
An individual faced a significant challenge in recovering a £38,000 debt from a defendant residing in Coventry. Despite obtaining a judgment with the assistance of a solicitor, the enforcement process proved difficult.
The defendant owned a vehicle and several properties, yet continuously evaded payment.
The Solution:
Our High Court enforcement team employed a strategic and persistent approach to address this challenging situation. A Notice of Enforcement was sent to the defendant, prompting them to contact us, they put forward a proposal to pay the debt once their house sale had gone through. However, the claimant’s solicitor instructed us not to wait for this uncertain outcome and to proceed with enforcement action.
An Enforcement Agent (EA) attended the defendant’s address and clamped their vehicle. Despite the defendant’s attempts to obstruct enforcement, the vehicle was removed and sold at a public auction, covering approximately a quarter of the original debt.
Despite the balance only being partly satisfied, Marston had successfully completed execution of the writ and exhausted their powers of enforcement. The defendant has continued to promise that the balance will be paid via the house sale proceeds and Marston has now returned the case to the claimant.
The Impact:

While the full recovery of the debt is pending the property sale, the claimant has seen tangible progress and remains assured of a favourable outcome.
