Criminal fines enforcement
Virtually all criminal court cases begin in Magistrates’ Courts and 95% of them finish there too. Fines, which make up the vast majority of sentences, are passed to Marston for enforcement when offenders do not comply with orders from the courts.
Marston has been a provider of enforcement to the Magistrates’ Courts for over 40 years. Our services include:
- The arrest and transportation of offenders to courts, detention at police or prison cells.
- The collection of court fines through supported (payment arrangements) and enforced compliance (the taking control of goods) where necessary and the enforcement of:
- Clamping Orders
- Confiscation Orders
Our continued success in the enforcement of criminal fines plays a pivotal role in ensuring that public confidence is maintained in the use of criminal fines as a sentencing option for magistrates.
Criminal Legal Aid Contributions
Legal Aid in England and Wales is administered by the Legal Aid Agency, which is an executive agency of the Ministry of Justice (MoJ). Marston has been delegated certain powers to support the collection of debts from those assessed as being eligible to pay towards their representation in the Crown Court. The Legal Aid fund must remain balanced and sustainable into the future, ensuring that assistance can be provided to those most in need.
Marston provides collection and enforcement services including:
- Collection of Contributions from Income, Capital and Equity (where applicable).
- Calculation and Issue of Capital Contribution Orders.
- Management of enforcement strategies such as:
- Charging Orders
- Third Party Debt Order
- Attachment of Earnings
- High Court Enforcement
- Motor Vehicle Order Clamping
Child maintenance arrears
The Child Maintenance Group is a delivery arm of the Department for Work and Pensions and is responsible for implementing the Child Support Act 1991. Its primary aim is to maximise the number of effective child maintenance arrangements in place for children who live apart from one or both their parents.
Marston is the sole provider to the Child Maintenance Group in the event that individuals do not sustain these arrangements and enforcement is required. We assist in recovery following the Taking Control of Goods Regulations and also carry out the execution of Arrest Warrants, both with or without bail conditions.
