Transfer County Court Judgment to the High Court
We can assist you by transferring your County Court Judgment to the High Court in order to obtain a High Court sealed Writ of Control for enforcement. Once this is obtained, Marston Legal Services Limited seamlessly transfers the High Court Writ to Marston Recovery.
The Writ of Control empowers the High Court Enforcement Officer to seize goods belonging to a judgment debtor and discharges the amounts due (including the High Court Enforcement Officers’ costs) either by way of payment or sale.
We will complete a Form N293A and pay a court fee of £78.00 to transfer the County Court Judgment to the High Court. This fee is recoverable from the debtor and it will be added to the amount owed by them. The fees for this service are set out in the table below. Where possible, we will seek to recover these costs from the judgment debtor/defendant.
Possessions
We can help you obtain a Warrant for Possession for both residential and commercial premises if the defendant does not leave the property by the date given by the Court. A warrant for possession may be issued by the court if they do not leave by this date. A warrant for possession may be issued by the court if they do not leave by this date. We can apply to transfer a Possession Order made by the County Court to the High Court for enforcement by a High Court Enforcement Officer. The fees for this service are set out in the table below. Where possible, we will seek to recover these from the judgment debtor/defendant.
Foreign Judgments
Foreign Judgments are often complex and in certain situations there is an increased level of uncertainty in the wake of Brexit. Our legal team can assist recognition and enforcement a foreign judgment within England and Wales including making the applications on your behalf, subject to exceptions.
Employment Tribunal Awards
Our legal team will assist in applying to the court to register the Employment Tribunal Award as a judgment and transfer it to the High Court for enforcement purposes.
