The challenge
Two individuals located in Worcestershire owed £5,000 to our claimant.
Our solution
The High Court Writ of Control was received by Marston Recovery and despite an early payment
on the matter, no contact was received, and an Enforcement Agent (EA) was instructed to attend
the address. The property was found to be a large, detached house, secured by padlocked gates.
The EA was able to see vehicles beyond the gates but could not access them or the property. It
was confirmed that one of the defendants resides, but they failed to come forward and deal with
the matter. Some weeks later the EA returned to the address and met with both defendants. They
were uncooperative and abusive and indicated that no payment would be made towards the
debt.
Following DVLA and financial checks on the vehicles seen by the EA, discussions were had with
the claimant and Marston made an application to the court for an order to force entry beyond the
secured gates at the property. This was successfully obtained, and the EA attended the property
with a locksmith in order to secure and remove the defendant’s vehicles.
The impact
The EA attended the address, forced entry beyond the gates and clamped the defendant’s vehicles.
Contact was then made and the defendant reluctantly transferred payment of the balance in full.
